AI is increasingly used to screen job applicants, score resumes, and rank candidates. While these tools promise objectivity and efficiency, they also introduce significant legal and reputational risks, particularly when trained on historical data that encodes prior human bias.
When deployed without proper governance, AI can transform past inequities into automated discrimination. This is a risk that touches civil rights compliance, regulatory oversight, brand trust, and corporate accountability.
Understanding the Risk: A Real-World Scenario
Imagine a global employer that implements an AI platform to evaluate and rank applicants. The model is trained on ten years of company hiring data. However, that data reflects a workforce historically dominated by male engineers and graduates of elite universities.
As a result, the algorithm learns to replicate these outcomes, assigning lower scores to female applicants or candidates from less-represented schools. This is a classic case of algorithmic bias – unintentional yet actionable under employment discrimination law.
Disparate Impact & Loss of Autonomy
Applicants rejected by an algorithmic screening system typically receive no explanation or opportunity to appeal. Warn your clients about the risk of misrepresentation. Companies that position their AI as “objective” while concealing bias may face allegations of deceptive trade practices in addition to employment law liability.
Mitigating Risk
To mitigate these risks, legal and compliance teams should advise clients to implement a robust governance framework. Counsel’s role is not just to react to litigation but to proactively build a defensible system. Advise clients to:
- Conduct Pre-Deployment Bias Testing: Ensure all AI systems are tested for disparate impact before they are used in a live environment.
- Audit Annually: Require annual validation audits to ensure the model has not drifted and continues to perform fairly.
- Maintain Human-in-the-Loop Review: Advise that all final employment decisions should be made by a human, not an algorithm. The algorithm should be a tool, not a replacement for human judgment.
- Require Vendor Accountability: Ensure vendor contracts include transparency obligations and bias-reporting warranties. The vendor should be responsible for providing the documentation you need to defend your client’s hiring decisions.
- Align with Governance Frameworks: Urge clients to adopt frameworks like the NIST AI Risk Management Framework and the ISO/IEC 42001 standard. This demonstrates a commitment to due diligence and can provide a strong defense in court.
