Husk Energy Failure to Pay the Required Minimum Wage and Overtime

Just last week the U.S. Department of Labor announced that Husk Energy, a petroleum refinery in Lima, Ohio, agreed to pay nearly $1,000,000 in back wages after an investigation by the Department of Labor in which it was found that its employees were not being paid overtime compensation.

Top 10 Wage-and-Hour Settlements Tally 44% More in 2009

Wage and Hour claims are on the rise in the workplace.  In a trend that is expected to continue in 2010, settlements in major wage-and-hour lawsuits against corporate defendants rose 44 percent last year. The top 10 cases in 2009 racked up a total of $364 million, compared to $253 million in 2008, a law firm known for its employment defense work reports, citing court records.

Does Hourly or Salary Pay Affects Happiness?

Does pay have an effect on employee happiness?  Will more money make you happier? Well, that depends on if you are paid hourly or by salary according to a new study published in Personality and Social Psychology Bulletin. Researchers from the University of Toronto and Stanford University have found that income was more strongly associated with happiness for individuals paid by the hour than by salary.

Under The FLSA Are Managers Always Exempt from Overtime Pay?

Companies better become aware of their responsibility under the FLSA.  The Fair Labor Standards Act clarifies rules for manager.  Managers generally are exempt from overtime compensation under state and federal wage and hour laws. However, it is important to remember that it is job duties and not job titles that determine whether or not an employee actually is exempt from this important source of increased compensation.

Walt’s Food Center Violates Child Labor Laws, Fined $55K

Walt’s Food Center grocery store, which has a location in Tinley Park, has been fined $55,000 by the US District Court in Chicago after an investigation by the US Department of Labor’s Wage and Hour Division found the company in violation of child labor provisions, according to a release from the Department of Labor.

Wage & Hour Compliance Report Gaps In ELT Study

Wage and Hour compliace still plays a major factor in workplace violation.  While 60 percent of respondents in another ELT survey reported providing extensive harassment and discrimination training to their workforces, employers are surprised to learn that there are now more wage and hour class action lawsuits than class actions arising from all other forms of discrimination, combined. However, less than a quarter of respondents reported providing 00004000 any kind of wage and hour training to their employees.
