ICE Cracks Down on Employers Nationwide

In an effort to hold employers accountable for their hiring practices and their efforts to keep their work force legal, U.S. Immigration and Customs Enforcement earlier this month issued 652 Notices of Inspection to businesses around the country pursuant to a new audit initiative.

The Notice of Inspection informs each business that ICE intends to inspect its hiring records, including Forms I-9, in order to determine compliance with employment eligibility laws and regulations.

Illegal Immigration, a Chicken and Egg Problem

Immigration Compliance Complexities

U.S. Senate Approves Several Amendments Dealing with Immigration Enforcement

President Obama focuses on Immigration Compliance and Enforcement

U.S. Immigration and Customs Enforcement (ICE) is launching a new audit initiativeby issuing Notices of Inspection (NOIs) to 652 businesses nationwide – which is more than ICE issued throughout all of last fiscal year. The notices alert business owners that ICE will be inspecting their hiring records to determine whether or not they are complying with employment eligibility verification laws and regulations. Inspections are one of the most powerful tools the federal government has to enforce employment and immigration laws. This new initiative illustrates ICE’s increased focus on holding employers accountable for their hiring practices and efforts to ensure a legal workforce.

The Department of Homeland Security (DHS) is offering good advice on completing the Form I-9.  Their recommendations are a great start in your company’s immigration compliance when hiring to avoid fines.

The Department of Homeland Security (DHS) requires employers to verify that all new employees are eligible to work in the U.S. using the employment eligibility verification form (Form I-9). Neglecting to fill out forms or filling out I-9 forms incorrectly can result in fines of up to $1,100 for every incorrect form.

New Forms I-9: Are you aware of the changes?

The Department of Homeland Security’s U.S. Citizenship and Immigration Services bureau has also published instruction for completing the Form I-9.  The instructions contain several significant changes.  Employers must be aware of these changes or the company could incur significant financial penalties.
