What Businesses Are Targets For Ice Inspections?

ICE selects the businesses that will be targeted for inspection. Certain industries may be under closer watch, such as construction, manufacturing, hotels and restaurants. However, all employers are subject to inspection. It doesn’t mean just because your business is not in one of these categories that ICE won’t visit you next.

Many, many times, ICE acts on the basis of a tip from a “concerned citizen”. Some ICE raids are the result of a tip form a disgruntled employee, unhappy customer, or mean-spirited competitor.

What Should Employers Know Right Now

Under the Bush administration, the focus of worksite enforcement actions was arresting illegal aliens. Under the Obama administration, however, the focus of the Department of Homeland Security (”DHS”) has shifted to criminal prosecution of employers. DHS made this clear in an April 30, 2009, memorandum setting out its worksite enforcement strategy and in a corresponding U.S. Immigration and Customs Enforcement (”ICE”) Worksite Enforcement Fact Sheet.

When Hiring Employees – Complying With Immigration Law

Last July, the federal government issued over 500 notices to businesses, informing them that they would be audited by the Immigration and Custom Enforcement (ICE) for compliance with immigration law.  In one month, ICE performed more audits than it did all last year.  In November, the Department of Homeland Security announced that another 1000 companies would be sent audit notices by ICE that month.

State Laws and Employer I-9 Employment Verification Responsibilities

Colorado HB 1343 (signed 6/6/2006) prohibits state agencies from entering into contract agreements with contractors who knowingly employ illegal immigrants and requires prospective contractors to verify legal work status of all employees. The contractor must confirm that the Basic Pilot Program has been used to verify the status of all employees. If the contractor discovers that an illegal alien is employed, the contractor must alert the state agency within 3 days.

Immigration Compliance Enforcement Is On The Move With Illegals

The numbers speak for themselves. In fiscal 2009, ICE removed a record number of aliens – 387,000 – more than any other administration in the nation’s history. ICE also removed a record number of criminal aliens – 136,000. In just the first year of our new Secure Communities initiative, ICE identified more than 111,000 aliens charged or convicted of crimes, and more than 11,000 of them were charged with or convicted of Level 1 crimes like murder and rape. This is a smart way to use resources and protect our communities.

Employer Should Be Aware Because The Immigrant Bill Is Back On The Table

Employers should be aware of the immigration bill.  Ms. Napolitano said the immigration landscape has changed sharply since 2007, when attempts at a comprehensive overhaul failed because many members of Congress lacked confidence in the government’s ability to enforce existing laws, she said. Immigration overhauls backed by the Bush administration and some congressional leaders from both parties foundered in part because critics portrayed them as rewarding illegal immigrants with “amnesty” for violating U.S. law.

The Turner Construction Company Responds To Illegal Immigrants Arrests

Companies are not sure from Notice of Inspections without regular audits.  As a result of the procedures established for this project, we have been informed that two subcontractors working on the courthouse project employed workers who provided information that did not match Federal records. Our understanding at this time indicates that individual employees of a subcontractor under contract with Turner may have submitted falsified employment documentation, which in turn led to the employment of those individuals. The fact that the documentation was falsified was identifiable to the ICE officials but was not known to Turner or, to our knowledge, to Turner’s subcontractor.
