Do Employers Know The Rules Of The Workplace?

February 14, 2010 by wgarnett

The rules of the workplace are playing an ever important role for companies.  Most employers are well aware that if they terminate an employee for any reason of if it’s a lay-off, they must pay that employee’s wages (which includes vacation and sick time if applicable) in full immediately upon discharge. But, what if an employee works for a certain company on per assignment basis, where upon completion of one assignment of a certain duration, the employee might have to wait a shorter or a longer period of time till he receives the next assignment, where having such future work is not even guaranteed.

I Hope Your Company Is Conducting Human Resource Audits In 2010

January 17, 2010 by wgarnett

Who’s handling you HR audits in 2010.  An HR audit can be conducted by your HR staff, an outside consultant or an employment law attorney. This individual must have significant HR experience and should use a checklist or structured method to assess a company’s risks and needs. In addition to bringing key advice and knowledge of all pertinent laws to the table, an audit conducted by an outside consultant can add an extra layer of credibility to the findings of the audit. Records from a self-audit do not have the same credibility as audits done by independent sources; however it is better to do a self-audit than not audit at all.

January 15, 2010 by wgarnett

Immigration Custom Enforcement (ICE) is keeping their foot on the accelerator audit pedal.  Yesterday, ICE announced that they were delivering 1,000 new Notices of Inspection (NOI) to businesses of all sizes throughout the United States – the largest single effort of this kind.  ICE stated that these audits will focus on critical infrastructure facilities, although we know of clients in the food service and retail industries that have already received NOIs as well.  Just as in the last round of audits, these audits should be served at your headquarters office, not at any of your field locations.

Wage and Hour compliace still plays a major factor in workplace violation.  While 60 percent of respondents in another ELT survey reported providing extensive harassment and discrimination training to their workforces, employers are surprised to learn that there are now more wage and hour class action lawsuits than class actions arising from all other forms of discrimination, combined. However, less than a quarter of respondents reported providing 00004000 any kind of wage and hour training to their employees.

To accomplish the inspections, DHS has established the Fraud Detection and National Security Division (FDNS). With nearly 600 officers and more than $90 million in funding (arising from the $500 fraud-detection fees for each initial H-1B or L-1 petition), the FDNS will conduct the 25,000 inspections, up from just over 5,000 in the previous fiscal year. The FDNS already has begun to dispatch officers to work sites throughout the United States.

Typically considered a lighthearted time of year, the holidays can pose difficulty for those celebrating in a workplace setting. “A new economy and changing corporate culture has left people so terrified about holding onto their jobs that they often won’t partake in any kind of holiday festivities at all,”  says Amy Epstein Feldman, co-author of “So Sue Me, Jackass!” “The unfortunate part is needlessly losing all that positive office spirit.”

October 14, 2009 by wgarnett

A recent federal court decision provides a text book example of how company e-mail policies when drafted and implemented properly can reduce or otherwise eliminate litigation.

Factual Background:

The plaintiff, Kevin Sporer contended that his former employer, United Air Lines invaded his privacy by viewing a pornographic video attached to an e-mail that Sporer sent from his work account to his personal account. Sporer also contended that United wrongfully terminated his employment. Sporer was a supervisor at the time of the discharge.
