The Internal Revenue Service (IRS) has announced that it will be focusing attention on issues that involve many HR departments. For some HR professionals this will likely be their first experience with an IRS audit. This article explains these developments and suggests actions that will help HR be prepared to handle IRS inquiries. The issues concern the reporting of, and withholding on, payments to foreign persons and the documentation of those persons’ status.

Ledbetter Act Prompts EEOC To Give Aggrieved Employees New Chance To Sue In Closed Cases

Some complainants in Equal Employment Opportunity Commission’s closed cases that involved wage issues may receive new right-to-sue notices from the agency. The Commission seems to be reviewing these cases in response to the signing of the Lilly Ledbetter Fair Pay Act early this year. This is an important development for employers because Congress has provided that individuals may file a civil action within 90 days after the notice of right to sue is given by the EEOC. 29 C.F.R. § 1601.28(e)(1). Thus, a new right-to-sue notice statutorily confers on claimants an additional 90 days to commence suit in cases that would have been barred by the original statute of limitations.

E-Verify Becomes Mandatory Employee Check for Federal Contractors

Lowe’s, Taco Bell Settle Sexual Harassment Lawsuits

PetSmart to Pay $125,000 to settle EEOC Sexual Harassment and Retaliation Lawsuit

The EEOC charged in its lawsuit that female employees were subjected to unwelcome sexual harassment by a store manager who worked first at the company’s Pottstown store and then at its Wyomissing store. The EEOC said that the store manager’s sexually offensive conduct and comments included repeatedly grabbing his genitals while talking to female employees and making explicit sexual comments and sexual innuendoes.

COURT RULES FOR DHS IN E-VERIFY LITIGATION

Court Rules Federal Contractors Must Use E-Verify Beginning September 8, 2009

Today, a U.S. District Court issued a long-awaited decision in Chamber of Commerce of the United States of America v. Napolitano; a case in which SHRM, along with the U.S. Chamber of Commerce, American Council on International Personnel, HR Policy Association, and Associated Builders and Contractors, Inc., challenged the legality of a Bush Administration Executive Order requiring that federal contractors use E-Verify to check the employment eligibility of all newly hired employees, as well as all current employees directly working on a contract.
