HR Strategy For Your Small Business
Every small and mid-sized business deals with human resources at some level, but many business owners or staff members (who are not HR professionals) are not properly trained to deal with handbook creation and maintenance, hiring, compliance, performance management, employee relations, terminations and other HR issues.

Unpaid Internships Under Spotlight
If you’re a for-profit employer or you want to pursue an internship with a for-profit employer, there aren’t going to be many circumstances where you can have an internship and not be paid and still be in compliance with the law.

HR Practices For Small Businesses
When I started on this journey I did not know what to expect. I have worked for large private and public sector employers for most of my career. I realised pretty early on that small businesses on the whole do not know what the minimum requirements are in terms of their HR responsibilities. Often HR is given to one of the partners or senior managers or even a personal assistant to look after. Some manage quite well, others miss things and not all the essential requirements are covered off leaving gaps and risks for the business.

HR Audit in Preventing Department of Labor Violations
All it takes is one disgruntled employee to complain that your company is using unfair labor practices and the next thing you know, the company is under a Department of Labor investigation.

The Hospitality Industry Is In the Sights of DOL
Armed with additional funding in the FY 2011 budget, Solis has gone on a hiring spree, adding 710 enforcement staff, including bilingual investigators. The number of inspectors has increased by more than one third. The department’s $14 billion discretionary budget request includes a 4 percent increase for worker protection programs, with the goal of restoring funding and staffing for these programs to FY 2001 levels.

Why Policies, Procedures, Manuals & Training are Important
There are strict labor laws governing minimum wage, rest breaks, and overtime. Overtime is one of the areas that is least understood and the area that employers try to circumnavigate. One argument or justification that employers try to use is the total number of hours worked in a pay period, rather than what the law clearly states, and that is overtime accrues on a week to week basis, regardless of the pay period.

Avoid Discrimination Lawsuits – Follow Simple Steps
As the saying goes, you get what you pay for. Employment discrimination lawsuits commonly cost tens of thousands to those who win them and hundreds of thousands more to those who don’t.
Employers face damages for lost wages, emotional injuries, an employee’s legal fees, and more. They can be ordered to train employees or submit to state oversight of their policies. Worst of all for defendants in employment discrimination lawsuits, they ultimately realize that the whole mess was preventable.

Employers Safe Harbor Are You There?
In the past year, the U.S. Department of Labor, the Equal Employment Opportunity Commission (EEOC), and the Internal Revenue Service all have announced a renewed focus on enforcement initiatives. With increased funding from the Obama administration, these agencies will have more investigators devoted to ensuring compliance with the laws that they enforce.

Determine Accurate “Work Time.”
The allegation relates to alleged working time, i.e. travel time, that the company did not pay workers for. These workers drive all over the New England performing installations, service and repairs. The case is entitled Nelson v. Ingersoll-Rand Co., and was filed in the U.S. District Court for the District of Massachusetts.

Sexual Harassment Claims Can Be Prevented
Workplace policies and training can prevent sex harassment claims. For example, the University of Texas Medical Branch at Galveston recently settled a case in which a male practice manager alleged that he had been sexually harassed by his female boss, and had been demoted when he complained. Due to a confidentiality agreement, none of the involved parties could comment.
