Employers Best Defense is a Good Offense – Good Faith Compliance

In other words, if you complete the Form I-9 correctly for every new hire and you do not acquire constructive knowledge and you use E-Verify, you will be able to demonstrate “good faith” in complying with the law. You should not have to worry about going to jail or going bankrupt if your business is the subject of an I 9 audit or raid by ICE (Immigration and Customs Enforcement).

E-verify, The Risk To Federal Contractors

E-Verify will soon be requi­red of all fede­ral contrac­tors. Many state legis­la­tures are also enac­ting state laws man­da­ting employer use of E-Verify.  Fede­ral (and in many states, state) contrac­tors are now requi­red to par­ti­ci­pate in the E-Verify pro­gram to confirm employ­ment eli­gi­bi­lity.  Although E-Verify is an exten­sion of and impro­ve­ment for the exis­ting I-9 laws all employee, it is also direc­ted at ille­gal immi­grant work authorization.

Changes To E-Verify Announced By USCIS

U.S. Citizenship and Immigration Services (USCIS) is planning important changes to the E-Verify online employment eligibility verification system, aimed at ensuring employer compliance with program rules and guarding against employment discrimination and identity theft. These new initiatives were announced at a March 17 briefing attended by Fragomen representatives and other stakeholders.

From the U.S. Department of Labor (DOL) and the Equal Employment Opportunity Commission (EEOC) to the Department of Homeland Security (DHS) and the National Labor Relations Board (NLRB), employers of all sizes are starting to see the effects of the Obama Administration’s workplace agenda. The watchword for all employers in 2010 is “compliance.” Each of these agencies is slated to receive a substantial budget increase this year and all of these agencies are planning hiring sprees to increase the number investigators and enforcement personnel.

A Shift In Enforcement By Immigration and Customs Enforcement (ICE)

The shift in immigration enforcement.  What new with Immigration Customer Enforcement?  But that was then, under a different presidential administration. Nowadays, ICE, which is part of the U.S. Department of Homeland Security, has shifted its focus away from undocumented workers and is targeting the employers who hire them. Rather than obtaining search warrants and kicking down doors, agents tend to call ahead before showing up to inspect paperwork. However, with this change in focus, owners, executives, and managers must take extra precautions to ensure that they do not end up paying hefty fines or even going to jail.

The Administration’s New Work Site Enforcement Initiatives

The Obama administration has announced new work site enforcement initiatives and goals that will likely increase the number of investigations as well as I-9 and H-1B audits. In many cases, these audits may be the preamble to criminal enforcement. The administration has pledged to aggressively investigate employers and pursue criminal enforcement wherever possible. While criminal enforcement against employers who hire unauthorized workers began under the Bush administration, recently criminal enforcement actions also have been brought in the H-1B context for egregious violations. The Obama administration has stated that, even more so than the prior administration, the focus will be on employer compliance with immigration rules.

Has The DHS Developed A Process For Verifying Eligibility To Work In The U.S.?

The Department of Homeland Security has developed a process for verifying work eligibility.  As part of the new-hire process, employers must verify that a new hire is either a U.S. citizen or is an alien entitled to work in the United States. Verifications must be made using Form I-9, Employment Eligibility Verification.

On the form, new hires must list their status (for example, U.S. citizen, permanent resident, or authorized alien) that authorizes them to work in the United States. New hires must also present to the employer certain documents that establish their identity and authorization to work.

They Are Not Authorized for Employment Who’s Checking?

Who’s checking to make sure you are legal to work in the United States?  ICE driving unauthorized (and underage) workers to work is astonishing enough.  It is over the top that the New England Patriots of the National Football League and Gillette Stadium do not use standard sound business practices with their subcontractors for Form I-9 and employment eligibility verification.  NFL football executives and teams are civilly and criminally liable for I-9 violations.  They should be replaced for their negligence alone.
