State Laws and Employer I-9 Employment Verification Responsibilities
Colorado HB 1343 (signed 6/6/2006) prohibits state agencies from entering into contract agreements with contractors who knowingly employ illegal immigrants and requires prospective contractors to verify legal work status of all employees. The contractor must confirm that the Basic Pilot Program has been used to verify the status of all employees. If the contractor discovers that an illegal alien is employed, the contractor must alert the state agency within 3 days.

DHS Test for Employer’s “Constructive Knowledge”
Form I-9 errors and violations of the I-9 employer sanctions laws. The new ICE I-9 workplace enforcement strategy targets employers. Employers must complete a Form I-9 for every new hire. Thus, employers must have a Form I-9 properly completed and on file for every employee on its payroll (hired after 1986). Employers are required to make its Forms I-9 available for inspection on three days’ notice.

ICE Storm Hitting Employers Form I-9 Compliance

DHS Announces Numerous Workplace Enforcement Initiatives
The Obama Administration has made workforce compliance the focus of its immigration enforcement efforts. In April 2009, DHS Secretary Janet Napolitano announced that the agency would shift its enforcement focus away from undocumented immigrants and onto employers. DHS is approaching compliance and enforcement on many fronts, ranging from these expanded audits and site visits to stricter adjudication policies and increased incidence of requests for evidence (RFEs) by immigration examiners.

Small Business Owners Feel Vulnerable to Employment Charges In a Weak Economy
The survey of small business owners found that 42 percent felt more vulnerable to employment charges because of a weak economy and recession-fueled layoffs. And 60 percent were aware of new employment laws and legislation that could maker it easier for workers to file an employment-related claim or lawsuit.

Immigration Compliance Updates – Turning the Page
On November 19, 2009, John Morton, Assistant Secretary of the U.S. Immigration and Customs Enforcement (ICE), announced that 1,000 new Notices of Inspection had been sent to employers across the U.S. This second round of administrative investigations follows 654 I-9 audits initiated in July of 2009.

Is E-Verify Between A Rock And A Hard Place?
Is E-Verify meeting all of its expectations? As of this writing, the Department of Homeland Security [DHS] has made the E-Verify program mandatory for most federal contractors [effective 9/8/2009.] It has also been a voluntary program for all employers since 1997, which DHS is now utilizing aggressively, along with other enforcement measures.
